LAND TRANSPORT (AMENDMENT) ACT 1999

AN ACT

TO AMEND THE LAND TRANSPORT ACT 1998

ENACTED by the Parliament of the Fiji Islands

Short title etc.

1.- (1) This Act may be cited as the Land Transport (Amendment) Act 1999.

(2) This Act comes into force on the date on which the principal Act comes into force.

(3) In this Act, "the principal Act" means the Land Transport Act 1998.

Interpretation

2. Section 2 of the principal Act is amended by -

(a) deleting the definition of "charter service";

(b) inserting after the definition of "load" the following new definition -

""mini-bus" has the meaning given to it by section 62(3)(e);".

Disqualification

3. Section 59 of the principal Act is amended in subsections (11) and (12) by deleting "(9)" and substituting"(10)".

Public service vehicles

4. Section 61 of the principal Act is amended in subsections (4) and (5) by adding "or mini-bus" after "omnibus".

Public service vehicle licences

5. Section 63 of the principal Act is amended in subsection (3)-

(a) in paragraph (d) (i) by deleting "12" and substituting "16";

(b) in paragraph (d) (ii) by deleting the full stop and substituting "; or" at the end; and

(c) by adding after paragraph (d) the following new paragraph -

"(e) a mini-bus licence, which shall only be issued in respect of a motor vehicle equipped for the conveyance of not less than 8 and not more than 15 persons excluding the driver.".

Public service permits

6. Section 65 of the principal Act is amended in subsection (2)-

(a) in paragraph (c) by deleting "or" at the end;

(b) in paragraph (d) by deleting the full stop at the end and substituting ";or";

(c) by adding the following new paragraph-

"(e) a mini-bus permit which authorise is the use of a vehicle licensed as a minibus, subject to this Act and licence and permit conditions, to ply or stand for hire in a base for which it is issued, or from an approved stand outside that base, for the carriage of passengers within, from or to that base.".

Special conditions relating to road permits

7. Section 66 of the principal Act is amended -

(a) in subsection (3) by inserting "or mini-bus permit" after "road permit" where it twice appears;

(b) by adding after subsection (4) the following new subsection -

"(5) In this section, "charter service" means the use of a public service vehicle for the transportation of passengers and goods on the basis of a contract for the hire of the vehicle as a whole between the holder of a road permit or a mini-bus permit and the hirer.".

Repeals and savings

8. Section 112 of the principal Act is amended-

(a) in subsection 6 by-

(i) deleting "Section 178 of the Criminal Procedure Code (Cap. 211)" and substituting "Section 175 of the Criminal Procedure Code (Cap. 21)";

(ii) deleting paragraph (a) and substituting-

"(a) by deleting "section 38 or 39 of the Traffic Act" and substituting "section 97, 98, 99 or 102 of the Land Transport Act 1998"";

(b) by adding the following new subsection-

"(7) The Motor Vehicle (Third Party Insurance) Act (Cap. 107) is amended-

"(a) in section 2(1) by deleting "any Traffic Act" in the definition of "driving licence" and substituting "the Land Transport Act 1998";

(b) in section 4(3) by deleting "the Traffic Act" and substituting "the Land Transport Act 1998".

Regulations

9. Section 113 of the principal Act is amended in subsection (1) by adding the following new paragraph-

"(f) quotas and conditions for the issue of licences for public service vehicles".
