AN ACT
TO IMPLEMENT THE SOCIAL JUSTICE PROVISIONS (CHAPTER 5) OF THE CONSTITUTION BY ESTABLISHING PROGRAMS OF AFFIRMATIVE ACTION AND FOR RELATED MATTERS
ENACTED by the Parliament of the Fiji Islands-
Short title
1. This Act may be cited as the Social Justice Act 2001.
Commencement and expiry
2.-(1) This Act comes into force on a date appointed by the Minister by notice in the Gazette.
(2) This Act expires on its tenth anniversary in accordance with section 44(7) of the Constitution.
Interpretation
3.-(1) In this Act, unless the context otherwise requires-
"affirmative action" means State policies to assist groups or categories of persons who are disadvantaged, so as to enable them to achieve equality of access with groups or categories who are not disadvantaged;
"disadvantaged", in relation to a group or category of persons, means that the group or category does not have equality of access by virtue of the actual or supposed personal characteristics of the members of the group or category or by virtue of the location or educational level of the category or group;
"equality of access" means equality of access to education and training, to land and housing, to participation in commerce and to participation in all levels and branches of service of the State;
"program" means a program of affirmative action specified in the Schedule.
(2) For the purpose of section 44(6) of the Constitution, "the Minister" in respect of a program means the relevant Minister responsible for the administering department or other agency specified in the Schedule in respect of the program.
(3) For the avoidance of doubt, any program or measure relating to access to land and housing is not to be construed as providing equality of access to any existing rights, interest or entitlement to ownership of land.
Establishment of programs
4.-(1) Each of the programs specified in the Schedule is established for the purpose of section 44 of the Constitution.
(2) In the Schedule, the following terms are to be construed in accordance with section 44(2) of the Constitution, namely-
"criteria" means, if the program is for the benefit of a group, the criteria for the selection of the members of the group who will be entitled to participate in the program, as in paragraph 44(2) (d);
"goals" means the goals of the program, also as in paragraph 44(2) (a);
"means" means the means by which those persons or groups are to be assisted to achieve the goals, as in paragraph 44(2) (b);
"performance indicators" means the performance indicators for judging the efficacy of the program in achieving the goals, as in paragraph 44(2) (c);
"target group" means the persons or groups the program is intended to benefit, as in paragraph 44(2) (a).
New programs, etc.
5. The relevant Minister must seek the approval of the Cabinet-
(a) to add a new program to the Schedule;
(b) to amend, suspend or delete a program in the Schedule;
(c) to change the administering department or agency for a program;
(d) to vary the target group, goals, means, performance indicators or criteria specified in the Schedule in relation to a program;
(e) to extend a program for any specified period but is subject to the expiry of this Act.
Monitoring of programs
6. (1) In accordance with section 44(6) of the Constitution-
(a) the administering department or agency for a program must monitor the efficacy of the program by reference to the performance indicators;
(b) a relevant Minister must cause to be prepared only one annual report on all the programs under his or her responsibility on the results revealed by the monitoring.
(2) The relevant Minister must table the annual report in Parliament no later than 30th September following the year to which the report relates.
Regulations
7. (1) The Minister may make regulations to give effect to the provisions of this Act.
(2) The Minister may, by regulations, amend the Schedule.
Existing programs
8. For the avoidance of doubt, it is declared that all programs of affirmative action Schedule that were in place at the commencement of this Act comply with section 44 of the Constitution.
