Marine Spaces (Foreign Fishing Vessels)
(Amendment) Regulations 2010
IN exercise of the powers conferred on me by Section 22 of the Marine Spaces Act, Cap 158A, I hereby make these Regulations -
Citation and Commencement
1. - (i) These Regulations maybe cited as the Marine Spaces (Foreign Fishing Vessels) (Amendment) Regulations 2010. ,
(ii) These Regulations are deemed to have come into effect on 1st January 2010.
New Regulation Inserted
2. The Marine Spaces (Foreign Fishing Vessels) (Amendment) Regulations 2002 is amended by insetting a new sub regulation after Regulation 32B sub regulation (5) -
Automatic location communicator
"32B (6) (i) Notwithstanding the requirements for the automatic location communicator to be registered with FFA such requirements will not apply to Fiji flagged vessels that are
(a) wholly owned by Fiji nationals and its fishing operation is confined to Fiji archipelagic waters and 12 mile territorial seas; and
(b) having less than 40m3 fish hold capacity and uses less than 2, 500 hooks per set.
(ii) The owners of the Fiji Flagged vessels are to install a vessel monitoring system of their own and allow the Director of Fisheries free access to the company vessel monitoring system data at all times with no cost to Government.
(iii) Failure to comply with sub-regulation (ii) will result in the owner of the fishing vessel having to fully comply with FFA registration requirements."
