An Act to prohibit the importation, sale, distribution and manufacture of fireworks and to provide for matters connected therewith or incidental thereto.

§1401. Short title.
This Chapter may be cited as the Fireworks (Prohibition of Importation) Act 1985. [P.L. 1985-2, §1.]
§1402. Interpretation.
As used herein, "fireworks" means any device for producing a striking display of light, noise or smoke by the combustion of any explosive
or flammable substances or any combination thereof.

§1403. Application.
This Chapter shall operate notwithstanding anything to the contrary in any other written law.

§ 1404. Importation of fireworks.
(1) No person shall bring or cause to be brought, or import or cause to be imported into the Republic any fireworks of any description whatever.
(2) Any person who in contravention of Subsection (1) of this Section brings or causes to be brought or imports or causes to be imported any fireworks shall be guilty of an offense and shall, upon conviction before the High Court, be liable to a fine not exceeding $5,000 or to a term of imprisonment not exceeding two (2) years, or both. §1405. Sale, distribution and manufacture of fireworks.
(1) No person shall sell, distribute or otherwise make available to the public or any member thereof, or manufacture, fireworks of any description.
(2) Any person who in contravention of Subsection (1) of this Section sells, distributes or otherwise makes available to the public or any member thereof, or manufactures, any fireworks shall be guilty of an offense and shall, upon conviction before the High Court, be liable to a fine not exceeding $1,500 or to a term of imprisonment not exceeding one year, or both. §1406. Exemption.
(1) The provisions of Sections 1404 and 1405 of this Chapter shall not apply to the Government of the Republic of the Marshall Islands, which shall be the sole importer and distributor of fireworks to be used:
- (a) in connection with government sanctioned public celebrations; and
- (b) in strict accordance with such regulations as are adopted pursuant to Sub-section (2)
(2) The Minister responsible for Public Safety shall adopt such regulations as are necessary to safely and effectively implement the provisions of Subsection (1). [P.L. 1993-51, §2.]
