COMMUNICABLE DISEASE PREVENTION AND CONTROL (AMENDMENT) ACT 2010

AN ACT

to amend Section 1507 of the Communicable Disease Prevention and Control Act 1988 by deleting subsection 5 and replace with a new language in its stead.

BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS:

Section 1. Short Title.

This Act may be cited as the Communicable Disease Prevention and Control (Amendment) Act, 2010.

Section 2. Amendments.

(1) Section 1507, Subsection (5) of the Communicable Disease Prevention and Control Act is deleted and replace with a new language to read as follows:

§ 1507. Testing, treatment, counseling, control.

(5) The Director of Public Health may impose on any person or related property, health care measures which may include testing, treatment, isolation or quarantine to prevent the spread of or exposure to disease that are a threat to the public.

(6) Subject to subsection (5), no person's liberty shall be restricted unless the Director of Health is convinced that the person's release would gravely endanger his or her own health or safety or the health, safety or property of others pursuant to Article II, Section 4 (10) of the Constitution.

Section 3. Effective Date.

This Act shall take effect in accordance with the Constitution and the Rules of Procedures of the Nitijela.
