LAND REGISTRATION AUTHORITY (AMENDMENT) ACT 2015

AN ACT

To amend Title 24, Chapter 4 of the MIRC, the Land Registration Authority Act, in order to prohibit subleasing of land in the Marshall Islands, except where it is agreed to by the landowners in the original master lease, or consent to by the landowners in writing.

BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS:

Section 1. Short title.

This Act may be cited as the Land Registration Authority (Amendment) Act, 2015.

Section 2. Amendment.

(1) Section 438 of the Principal Act is amended by inserting a new section, to read as follows:

"Section 438A. No Subleases

No lease shall be subject to sublease unless specifically agreed to by the landowners in the original master lease, or consent to by the landowners in writing."

Section 3. Existing Subleases

This Act shall not affect the validity of land subleases currently in effect as of the effective date of this Act.

Section 4. Effective Date.

This Act shall take effect on the date of certification in accordance with the relevant provisions of the Constitution of the Republic of the Marshall Islands and the Rules of Procedure of the Nitijela.
