TECHERENG BAULES for ONGEROOL CLAN,
Plaintiff-Appellant
v.
JOHN O. NGIRAKED, Palau District Land Management Officer,
and DELBIRT RULUKED,
Defendants-Appellees
Civil Appeal No. 114
Appellate Division of the High Court
Palau District
August 8, 1975
Counsel for Plaintiff-Appellant: ROMAN TMETUCHL
Counsel for Defendants-Appellees: KALEB UDUI
HEFNER, Associate Justice
It appears that the certification of record was served on the appellant on March 19, 1975, and pursuant to Rule 32 (h) (2), Rules of Criminal Procedure (also applicable in civil actions), the appellant's brief was due 60 days from that date. It further appears that no brief has been filed by the appellant, and that in accordance with Rule 32 (d), Rules of Criminal Procedure (also applicable in civil actions), the appeal may be dismissed. After consideration of the record and file in this case, the Court finds that the appeal should be dismissed for failure to prosecute the appeal in accordance with the Rules, as provided by 5 TTC Section 52. Now, therefore,
It is hereby ordered, the appeal in the above entitled matter be and is hereby dismissed.
