NINTH OLBIIL ERA KELULAU

AN ACT
To implement the Twelfth Amendment to the Constitution by amending Chapter 1 of Title 3 of the Palau National Code to provide that the first regular session of the Olbiil Era Kelulau following a general election shall commence on the fourth Tuesday in January, and for other related purposes.
THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:
Section 1. Legislative findings. In light of the Twelfth Amendment to the Constitution of the Republic of Palau, which mandates that installation of the members elect of each house of the Olbiil Era Kelulau shall take place on the third Thursday of January after the general election and that each house shall convene its meeting on the fourth Tuesday in January following the regular general election, it is necessary for the Palau National Code to be amended accordingly. 3 PNC §§ 108 and 109 currently provide that the first regular session following a regular general election will commence on the second Tuesday in January. With the amendments to those sections proposed in this bill, the code will be brought in conformance with the Constitution and provide that the first regular session following a regular general election will commence on the fourth Tuesday of January.
Section 2. Amendment. 3 PNC § 108 is hereby amended as follows:
Ҥ 108. Regular sessions.
There shall be four regular sessions of the Olbiil Era Kelulau each year, commencing on the second Tuesday of the months of January, April, July, and October, with the exception of the first regular session following a regular general election, which shall commence on the fourth Tuesday in January. Each such session shall continue for not to exceed 25 consecutive calendar days.”
Section 3. Amendment. 3 PNC § 109 is hereby amended as follows:
Ҥ 109. Numbering of regular sessions.
The session of each Olbiil Era Kelulau which commences on the fourth Tuesday in January following a regular general election shall be known and designated the “First Regular Session.” Each regular session thereafter shall be known and designated by the next ordinal number following that of the preceding regular session, followed by “Regular Session.””
Section 4. Effective date. This Act shall take effect upon its approval by the President of the Republic, or upon becoming law without such approval, except as otherwise provided by law.
