AN ACT
To reinstate disability benefits under the Civil Service Pension Plan under the previous terms and conditions of eligibility, and for other related purposes.
THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:
Section 1. Legislative findings. Disability retirement benefits granted under the Civil Service Pension Plan provide necessary income to Palauans who are totally and permanently disabled and no longer able to perform services for the Government of the Republic of Palau. This bill reinstates disability retirement benefits that were erroneously removed to ensure that no one will lose any benefit that they were entitled to under previous law.
Section 2. Amendment. Title 33 of the Palau National Code is amended to add a new Section 2045 to read as follows:
"§2045. Disability retirement.
An employee or former employee is entitled to a disability retirement annuity if:
(1) the employee is not otherwise eligible to receive normal, early or late retirement benefits;
(2) the employee is permanently disabled due to a physical or mental condition and is unable to be employed;
(3) the employee is not receiving a disability payment from the United States government or its agencies for substantially the same injury for which the employee seeks disability benefits under this Chapter; and
(4) the employee had completed at least ten years of service, if that employee's disability resulted from a cause unrelated to the employee's service."
Section 3. Retroactive effect.
The Civil Service Pension Board shall adopt rules or regulations to effectuate the purposes of this Act in order to reinstate any disability retirement benefits that were lost and to continue disability retirement benefits. The Civil Service Pension Board shall pay each employee or former employee that lost such disability retirement benefits within sixty (60) days of the effective date of this Act.
Section 4. Effective date. This Act takes effect upon its approval by the President of the Republic of Palau or upon becoming law without such approval.
