AN ACT

To amend 22 PNC § 229 to ensure rulemaking for the Scholarship Board follows APA procedures, to amend 24 PNC § 1281 to prohibit the taking or intentional killing of hawksbill turtles until April 1, 2021, and for other related purposes.

THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:

Section 1. Legislative findings.

The Olbiil Era Kelulau finds that the Administrative Procedure Act in Title 6 of the Palau National Code sets forth the law regarding the establishment of agency rules and regulations. This bill will ensure that the Scholarship Board will promulgate and establish rules in the same manner as other agencies bound by the Administrative Procedure Act.

Section 2. Amendment.

Amend 22 PNC § 229 as follows:

"§ 229. Authorization; Scholarship Fund.

(a)...

...

(h) Regulations issued by the Scholarship Board will be promulgated through the process established by the Administrative Procedure Act, Title 6 of the Palau National Code."

Section 3. Amendment.

24 PNC § 1281 is amended to read as follows:

"(a)...

(b)...

(c) No hawksbill turtle shall be taken or intentionally killed, regardless of location or size of the turtle, until April 1, 2021."

(d)..."

Section 4. Effective date.

This Act shall take effect upon its approval by the President of the Republic of Palau, or upon its becoming law without such approval.
