VISITING FORCES RULES 2004
These are the Visiting Forces Rules 2004.
2 Interpretation
In these Rules —
"member" includes any person defined as being within the visiting forces legislation of New Zealand;
"visiting force" in relation to a sending state, any body, contingent, or detachment of the naval, military, or air forces of any state, and includes reserve and auxiliary forces.
3 Lawful presence
No visiting force may operate in Tokelau without the prior express consent of the Council for the Ongoing Government after such consultation as is appropriate with the Taupulega of any village affected.
4 Jurisdiction over visiting forces
(1) Subject to paragraphs (2) and (3), the members of a visiting force shall be subject to the ordinary laws of Tokelau.
(2) A visiting force may, within Tokelau, exercise and perform all the functions, duties, and powers confirmed or imposed on it by the law of the sending state in relation to the command, control, and administration of the visiting force.
(3) To the extent permitted by the visiting forces legislation of New Zealand, a visiting force may, within Tokelau, exercise over its members all criminal and disciplinary jurisdiction conferred on it by the law of the sending state.
