BIRDS AND FISH PRESERVATION AMENDMENT ACT

AN ACT
TO AMEND THE BIRDS AND FISH PRESERVATION ACT

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:-

Short title.

1. This Act may be cited as the Birds and Fish Preservation (Amendment) Act 1989.

Commencement.

2. This Act shall come into force on the day that the Fisheries Act, 1989 comes into force.

Amendments.

3. The Birds and Fish Preservation Act is amended as follows:-

(i) by deleting the words "and Fish" in the long title, Part I and Section 1;

(ii) by repealing the definition of "protected fish" in Section 2;

(iii) by amending Section 3 by deleting the words "or fish" after "bird", in the second line, by replacing the words "First and Second Schedule" with the words "First Schedule", and by deleting the words "or fish" after "bird" in the sixth line, and by deleting the words "or fishes" at the end of the Section;

(iv) by deleting in Section 4 the words "or the Second" before the word "Schedule";

(v) by deleting in Section 5 after the word "bird" the words "or fish" and by deleting the words "First and Second Schedules" and replacing them with the words "First Schedule";

(vi) In Section 7 by deleting subparagraph (iv);

(vii) In Section 8 by deleting the words "or protected fish, or fish unlawfully taken from a protected area";

(viii) by repealing the second schedule to the Act.

(ix) by deleting the words "Third Schedule" whenever they appear and by replacing them with the words "Second Schedule".

Passed in the Legislative Assembly this 4th day of October, 1989.
