CRIMINAL OFFENCES (AMENDMENT) ACT 2003

AN ACT
TO AMEND THE CRIMINAL OFFENCES ACT

[24th of July, 2003.]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Criminal Offences (Amendment) Act, 2003.

(2) The Criminal Offences Act (Cap. 18), as amended, is referred to in this Act as the Principal Act.

2. The Principal Act is amended by inserting the following new section after section 115 -

"Child pornography

115A. (1) Any person who, wilfully in any manner-

(a) publishes child pornography;

(b) produces child pornography for any purpose; or

(c) possesses child pornography:

commits an offence punishable, upon conviction:

(i) in the case of an individual, by a fine not exceeding $100,000 or imprisonment for a period not exceeding 10 years; or

(ii) in the case of a corporation by a fine not exceeding $250,000.

(2) It is a defence to a charge of an offence under subsections (1)(a) or (1)(c) if the person establishes that the child pornography was a bona fide scientific, research, medical or law enforcement purpose.

(3) For the purposes of this section -

(a) the expression "child pornography" includes material that visually depicts -

(i) a child engaged in sexually explicit conduct;

(ii) a person who appears to be a child engaged in sexually explicit conduct; or

(iii) images representing a child engaged in sexually explicit conduct;

(b) the expression "child" means a person under the age of 14 years;

(c) the expression "publish" includes to -

(i) distribute, transmit, disseminate, circulate, deliver, exhibit, lend for gain, exchange, barter, sell or offer for sale, let on hire or offer to let on hire, offer in any other way, or make available in any way;

(ii) have in possession or custody, or under control, for the purpose of doing an act referred to in sub-section (1); or

(iii) print, photograph, copy or make in any other manner (whether of the same or of a different kind or nature) for the purpose of doing an act referred to in sub-section (1)."

(i) ha tamasi'i 'oku fakahoko ha anga fakalielia mata'a'a;

(iii) ha ngaahi 'ata 'oku ne fakafotunga ha tamasi'i 'oku fakahoko ha anga fakalielia mata'a'a;

(b) ko e kupu'i lea "tamasi'i" 'oku 'uhinga ki ha tamasi'i pe ta'ahine 'oku si'i hifo hono ta'u motu'a 'i he ta'u 14;

(c) ko e kupu'i lea "pulusi" 'oku kau ki ai 'a hono -

(i) tufaki, 'ave, fakamafola, tufa takai, Ioatu, fakahaha, 'omai ke ma'u ha tupu, fakafetongi, fakafetongi koloa, fakatau atu pe tu'uaki ke fakatau atu, no atu pe tu'uaki ke no atu, tu'uaki 'i ha founga kehe, pe faka'ata 'i ha founga;

(ii) ma'u pe tauhi pe pule'i 'o fakataumu'a ki hono fakahoko ha ngaue 'oku kau ki ai 'a e kupu si'i (1); pe

(iii) paaki, faita, hiki tatau pe fa'u 'i ha founga kehe ('i ha natula tatau pe kehe) koe'uhi ko e taumu'a ke fakahoko ha ngaue 'oku kau ki ai 'a e kupu si'i (1)."
