EXTRADITION (AMENDMENT) ACT 1993

AN ACT
TO AMEND THE EXTRADITION ACT

[18th October, 1993]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Extradition (Amendment) Act 1993.

(2) The Extradition Act (Chapter 22) is in this Act referred to as the Principal Act.

2. Section 5 of the Principal Act is repealed and replaced with the following Section:

"5. (1) For the purpose of this Act an offence of which a person is accused or has been convicted in a designated country is a relevant offence if the offence however described is punishable both in Tonga and in the designated country concerned by imprisonment for a term of two years or more.

(2) An offence that is a relevant offence under subsection (1) shall not cease to be such by reason only that it is purely fiscal in character."

3. Section 6 of the Principal Act is amended -

(a) by the repeal of subsection (5) and its replacement with the following subsection:

"(5) The reference in this section to an offence of a political character does not include -

(a) an offence against the life or person of a Head of State or a member of his immediate family or any related offence; or

(b) an offence against the life or person of a Government Minister, or any related offence; or

(c) murder or any related offence; or

(d) an act declared to constitute an offence under a multilateral international convention whose purpose is to prevent or repress a specific category of offences and which imposes on Tonga and the designated country concerned an obligation either to extradite or to prosecute the person sought; or

any offence of genocide as defined by the Genocide Act, and any related offence including any direct or public incitement to commit such an offence, and it shall not be an objection to any proceedings taken against a person by virtue of the provisions of this Act that under the law in force at the time when and in the place where he is alleged to have committed the act of which he is accused or of which he was convicted he could not have been punished therefor.";

and

(b) by the insertion after subsection (5) of the following subsection:

"(6) For the purpose of subsection (5), references to any related offence include in each case offences of attempting or conspiring to commit, of assisting, counselling or procuring the commission of or being accessory before or after the offences, and of impeding the apprehension or prosecution of persons guilty of those offences."

4. Section 7 of the Principal Act is amended -

(a) in subsection (2) by the insertion at the end of the subsection of the following proviso -

"Provided that if the Order in Council declaring the country concerned to be a designated country in terms of section 4 so provides, the request may be accompanied by a record of the case in respect of the offence concerned containing the particulars and documents referred to in subsection (2a), and accompanied by -

(i) an affidavit, sworn statement or affirmation of an officer of the investigating authority of the designated country stating that the record was prepared by him or under his direction and that the evidence referred to therein has been preserved for use in court; and

(ii) a certificate of the Attorney-General or the Principal Legal Officer of the Government of the designated country stating that, in his opinion, the record discloses the existence of evidence under the law of the designated country sufficient to justify a prosecution;"

and

(b) by the insertion after subsection (2) of the following subsections -

"(2a) A record of the case referred to in the proviso to subsection (2) of this section shall contain -

(a) particulars of the description, identity, nationality and, to the extent available, the whereabouts of the person sought; and

(b) particulars of each offence and conduct in respect of which extradition is requested, specifying the date and place of commission, the legal definition of the offence and the relevant provisions in the law of the designated country; including a certified copy of any such definition in the written law of that country; and

(c) the original or a certified copy of any warrant or process issued in the designated country against the person whom it seeks to have extradited; and

(d) a recital or summary of the evidence acquired to support the request for extradition of the person sought; and

(e) a certified copy, reproduction or photograph of exhibits or documentary evidence.

(2b) Any certification required by subsection (2) may be done by any person in the designated country concerned who is or holds office as the Attorney General or a legal practitioner, notary public, commissioner of oaths or commissioned police officer."

5. Section 9(4) of the Principal Act is repealed and replaced with the following subsection:

"(4) Where an authority to proceed has been issued in respect of the person arrested and the court of committal is satisfied, after hearing any evidence tendered in support of the request for the return of that person or on behalf of that person, that the offence to which the authority relates is a relevant offence and is further satisfied, either -

(i) where the person is accused of the offence, that the evidence would be sufficient to warrant that person's trial for that offence if it had been committed within the jurisdiction of the court; or

(ii) where the person is alleged to be unlawfully at large after conviction of the offence, that he has been so convicted and appears to be so at large; or

(iii) in a case in which a record of the case has been submitted in terms of the proviso to subsection (2) of section 7, that the record of the case would be sufficient according to the law of the designated country concerned to warrant the trial of the offences for which his return has been requested or that he has been convicted of such offence and is required to be sentenced or to undergo any sentence therefor in the designated country concerned, as the case may be;

the court shall, unless his committal is prohibited by any other provision of this Act, commit him to custody to await his return thereunder; but if the court is not so satisfied or if the committal of that person is so prohibited, the court shall discharge him from custody."

6. Section 11 of the Principal Act is amended-

(a) in subsection (2) by the insertion of the words "other than an order made under subsection (2a)" between the words "order" and "shall" in the first line; and

(b) by the insertion after subsection (2) of the following subsection -

"(2a) An order may be made under this section for the temporary return of a person who is serving a sentence of imprisonment or detention, in Tonga if that person, although serving a prison sentence had committed a relevant offence in a designated country, and the designated country concerned had requested his return for the purpose of enabling proceedings to be brought against him in relation to the offence in the designated country, upon such conditions as may be agreed between the Government of Tonga and the Government of the designated country concerned."

7. Section 13 of the Principal Act is amended in subsection (1) by the insertion of the following immediately after the comma and before the word "including" on the first line:

"excluding proceedings for committal in which a record of the case has been submitted in terms of the proviso to subsection (2) of section 7, but."

8. Schedule I to the Principal Act is repealed.

6. 'Oku fakatonutonu 'a e kupu 11 'o e Tefito'i Lao -
