FISHERIES MANAGEMENT (AMENDMENT) ACT 2004

AN ACT

TO AMEND THE FISHERIES MANAGEMENT ACT

[21st September, 2004.]

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Fisheries Management (Amendment) Act 2004.

(2) The Fisheries Management Act 2002 is in this Act referred to as the Principal Act.

2. Section 2 of the Principal Act is amended by deleting from the definition of "Fish Stocks Agreement" the following –

"(a copy of the English text of which is set out in Schedule 1)".

3. Section 2 of the Principal Act is amended, in the Tongan Version only, by repealing the definition of the word "me'a tohoaki ika" and substituting with " 'oku 'uhinga ki ha me'a kuo ngaohi 'o fakatëtë pe tömoloto, tatau ai pë, pe 'oku taula pe 'ikai, 'o fakataumu'a ki hono tohoaki'i 'a e ika, 'o kau ai mo ha me'a tëtë fakaenatula kuo fakapipiki ki ai 'a e me'a ke faka'ilonga'i 'a hono tu'u'anga".

4. Section 19(1) of the Principal Act is amended, in the English version only, by inserting the word "with" after the word "may".

5. Section 22 of the Principal Act is amended by deleting the words "From prescribed in the Schedule to the Secretary" and substituting with "prescribed form".

6. Section 31(1) of the Principal Act is amended, in the English version only, by deleting the words "sued for fishing or" and substituting with the words "permitted to fish or carry out any".

7. Section 71(1) of the Principal Act is amended, in the English version only, by inserting the word "may" after the word "officer".
