IMMIGRATION (AMENDMENT) ACT 2001

AN ACT
TO AMEND THE IMMIGRATION ACT

[13th September, 2001.]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Immigration (Amendment) Act 2001.

(2) The Immigration Act (Cap. 62), as amended, is in this Act referred to as the Principal Act.

2. The Principal Act is amended by inserting the following new definition in section 2 thereof:

""arrival card" means an arrival card in the form approved by the Principal Immigration Officer and notified to any airline carrying passengers into the Kingdom to be completed by any person disembarking in the Kingdom, and furnished to the Immigration Officer under section 20;".

3. The Principal Act is amended by inserting the following new section 13A after section 13:

"13A (1) Any airline operating a flight to the Kingdom carrying passengers shall, during the flight over to the Kingdom -

(i) distribute an arrival card to any passenger disembarking in the Kingdom; and

(ii) request that all arrival cards must be completed before passengers disembark from the aircraft in the Kingdom.

(2) Any airline in contravention of the provisions of this section shall upon conviction be liable to a fine not exceeding $10,000."

3. 'Oku fakatonutonu 'a e Tefito'i Lao' 'aki hono fakahu atu 'a e kupu 13A fo'ou ko 'eni' hili 'a e kupu 13:

"13A (1) Kuo pau ki ha fa'ahinga kautaha vakapuna pe 'oku ne uta mai ha kau pasese 'i ha puna ki he Pule'anga ni, lolotonga ko is 'a e puna ki he Pule'anga ni ke ne -

(i) tufa ha kaati tu'uta ki ha pasese pe 'oku hifo 'i he Pule'anga' ni; mo
