LAND (AMENDMENT) ACT 1999

AN ACT
TO AMEND THE LAND ACT

[1st July, 1999]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Land (Amendment) Act 1999.

(2) The Land Act (Cap. 132), as amended, is in this Act referred to as the Principal Act.

2. Section 19 of the Principal Act is amended in subsections (3) and (7) by inserting the following after the word "leases":

"(1) (including sub-leases)".

3. Section 109 (2) of the Principal Act is amended by inserting a comma at the end thereof and adding the following:

"or he may sell the lease or sub-lease if the mortgaged land is a leasehold".

4. Form No. 3 in Schedule LX of the Principal Act is amended by deleting paragraph (c) therefrom.

2. 'Oku fakatonutonu 'a e kupu 19 'o e Tefito'i Lao 'i he kupu-si'i (3) mo e (7) 'aki hono fakahu ant 'eni hili 'a e fo'i lea "ngaahi lisi":

"(kau ki ai mo e ngaahi to e lisi)".

3. 'Oku fakatonutonu 'a e kupu 109(2) 'o e Tefito'i Lao 'aki hono fakahu atu 'a e koma 'i hono ngata'anga pea tanaki atu 'eni:

"pe 'e ngofua ke ne fakatau ant 'a e lisi pe ngaahi to e lisi kapau ko ha 'api lisi 'a e kelekele kuo mokisi".

4. 'Oku fakatonutonu 'a e Sipinga Fika 3 'i he Tepile LX 'o e Tefito 'i Lao 'aki hono tamate'i 'a e palakalafi (c).
