MENTAL HEALTH (AMENDMENT) ACT 2004

AN ACT
TO AMEND THE MENTAL HEALTH ACT

[27th July, 2004.]

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Mental Health (Amendment) Act 2004.

(2) The Mental Health Act 2001 is in this Act referred to as the Principal Act.

2. Section 3 of the Principal Act, in the English version only, is amended as follows -

(a) the definition of "mental disorder", deleting "other" and substituting it with "others";

(b) the definition of "mental health practitioners", deleting "to" after "skill" and before "relating"; and

(c) the definition of "representative", deleting "interest" and substituting it with "interested".

3. Section 6 of the Principal Act, in the English version only, is amended by deleting "authorized" and substituting it with "authorised".

4. Section 8(1) of the Principal Act, in the English version only, is amended by deleting the first and second appearances of "psyciatrist" and substituting it with "psychiatrist".

5. Section 13(2) of the Principal Act, in the English version only, is amended by deleting "psyciatrist" and substituting it with "psychiatrist".

6. Section 24(2) of the Principal Act, in the English version only, is amended by deleting "amy" and substituting it with "may".

7. Section 26(2) of the Principal Act, in the English version only, is amended by inserting "the" between "If" and "authorised".

8. Section 28(1) of the Principal Act, in the English version only, is amended by inserting "a" between "after" and "person".

9. Section 29 of the Principal Act, in the English version only, is amended by deleting "review" and substituting it with "reviewed".

10. The marginal note of section 36 of the Principal Act, in the English version only, is amended by deleting "Requirements" and substituting it with "Requirements".

11. The marginal note of section 40 of the Principal Act, in the English version only, is amended by inserting "to" after "Authority".

12. Section 41(b) of the Principal Act, in the English version only, is amended by -

(a) deleting the second appearance of "treatment" and substituting it with "treatments"; and

(b) inserting "that electroconvuisive therapy is the proper treatment" between "treatments" and "to".

13. Section 85(f) of the Principal Act, in the English version only, is amended by inserting a comma after "movement".

14. The marginal note of section 89 of the Principal Act, in the English version only, is amended by deleting "patient's right" and substituting it with "patients' rights".

15. Section 98 of the Principal Act, in the English version only, is amended by inserting "he" between "committed" and "shall".

16. Section 103(a) of the Principal Act, in the English version only, is amended by inserting "duties" after "his".

17. Section 104(b) of the Principal Act, in the English version only, is amended by deleting "contact" and substituting it with "contract".

18. Section 110 of the Principal Act, in the English version only, is amended by inserting "a complaint" in between "considers" and "to".

19. Section 111(2) of the Principal Act, in the English version only, is amended by deleting "for" and substituting it with "to".

20. Section 127 of the Principal Act, in the English version only, is amended by -

(a) inserting "Review" between "Health" and "Tribunal"; and

(b) deleting the second appearance of "shall".

21. Section 130 of the Principal Act, in the English version only, is amended by -

(a) deleting the number (1);

(b) deleting "misbehavior" and substituting it with "misbehaviour";

(c) inserting a semi-colon after "misbehaviour"; and

(d) inserting a semi-colon after "duty".

22. Section 131 of the Principal Act, in the English version only, is amended by deleting "consider" and substituting it with "considers".

23. Section 132 of the Principal Act, in the English version only, is amended by inserting "be to" after "Tribunal shall".

24. Section 132(e) of the Principal Act, in the English version only, is amended by deleting "orders" and substituting it with "order".

25. Section 133(1)(c) of the Principal Act, in the English version only, is amended by deleting the second appearance of "not".

26. Section 134(1) of the Principal Act, in the English version only, is amended by deleting the dash between "may" and "appear".

27. Section 135(2) of the Principal Act, in the English version only, is amended by inserting "or" between "record" and "report".
