NURSES (AMENDMENT) ACT 2004

AN ACT
TO AMEND THE NURSES ACT

[19th July, 2004.]

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Nurses (Amendment) Act 2004.

(2) The Nurses Act 2001 is in this Act referred to as the Principal Act.

2. The Long title of the Principal Act, in the English version only, is amended by -

(a) inserting a comma after "COMPLAINTS"; and

(b) inserting "THE" before "CONDUCT".

3. Section 3(2)(e) of the Principal Act, in the English version only, is amended by deleting "advice" and substituting it with "advise".

4. Section 3(8) of the Principal Act, in the English version only, is amended by inserting "Officer" after "Nursing".

5. Section 8(1) of the Principal Act, in the English version only, is amended by deleting "the" before "midwife".

6. Section 13(1) of the Principal Act, in the English version only, is amended by deleting the opening bracket "(" where it immediately appears before "prescribed".

7. Section 13(4) of the Principal Act, in the English version only, is amended by deleting "an" and substituting it with "and".

8. Section 17 of the Principal Act, in the English version only, is amended by inserting "may" after the first appearance of "Board".

9. Section 21(a) of the Principal Act, in the English version only, is amended by deleting "judgement" and substituting it with "judgment".

10. Section 22(3) of the Principal Act, in the English version only, is amended by deleting the first appearance of "as" and substituting it with "and".

11. Section 24 of the Principal Act, in the English version only, is amended by deleting "amy" and substituting it with "any".

12. Section 27 of the Principal Act, in the English version only, is amended by deleting the indentation of the final paragraph.

13. Section 28(2) of the Principal Act, in the English version only, is amended by deleting "in".

14. Section 29(1) of the Principal Act, in the English version only, is amended by deleting "medical practitioner, health officer, dentist or dental therapist" and substituting it with "nurse or midwife".

15. Section 30(1) of the Principal Act, in the English version only, is amended by deleting "medicine or dentistry" and substituting it with "nursing or midwifery".

16. Section 33(2) of the Principal Act, in the English version only, is amended by deleting the second appearance of "in relation".

17. Section 35(2) of the Principal Act, in the English version only, is amended by inserting "make" after "shall".

18. Section 38 of the Principal Ac., in the English version only, is amended by deleting "ne" and substituting it with "be".

19. Section 39 of the Principal Act, in the English version only, is amended by deleting "or causes to be made or produces".

20. Section 40 of the Principal Act, in the English version only, is amended by inserting "or" between "Act" and "any".

21. Section 44(1) of the Principal Act, in the English version only, is amended by inserting "Register of" after "Nursing Section of the".

22. Form 2 in the Schedule of the Principal Act, in the English version only, is amended by -

(a) deleting "practice" and substituting it with "practice"; and

(b) deleting "register" and substituting it with "registered".
