PUBLIC HEALTH (AMENDMENT) ACT 2005

AN ACT TO AMEND THE PUBLIC HEALTH ACT 1992

I assent,

'ULUKALALA LAVAKA ATA,

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1 Short title

This Act may be cited as the Public Health (Amendment) Act 2005.

2 Amendment

Part VI of the Public Health Act 1992, as amended, is hereby repealed.

3 Savings

Notwithstanding section 2, all:

(a) arrangements made for the collection, transport and disposal of wastes under section 91;

(b) arrangements for the cleaning and efficient functioning of latrines, cesspits and other receptacles for sewage under section 92;

(c) requirements and procedures applying to dustbins under section 93;

(d) arrangements for cleaning streets and other public places under section 95;

(e) approved sites and arrangements for the reception of wastes under section 96; and

(f) approvals and permissions granted under section 97,

shall continue to have full force and effect in the waste management service areas designated under section 4(2) of the Waste Management Act 2005 until varied or revoked by the Minister of Health.

4 Legal proceedings

All legal proceedings instituted under Part VI of the Public Health Act 2002 and not finalised as at the date of its repeal are hereby saved.
