Public Health (Amendment) Act 2009

I assent,

AN ACT TO AMEND THE PUBLIC HEALTH ACT

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Public Health (Amendment) Act 2009.

(2) The Public Health Act 2008 shall be referred to in this Act, as the Principal Act.

2. Section 2 of the Principal Act is amended by inserting the following definitions in the appropriate places:

""National Biosafety Advisory Committee" means the National Biosafety Advisory Committee established under section 5 of the Biosafety Act;"; and
""living modified organism" has the same meaning as under the Biosafety Act;".

3. The Principal Act is amended by inserting the following as section 29A:

"29A Orders relating to living modified organisms
The Minister shall make appropriate orders or exercise any power under this Part to give effect to any decision of the National Biosafety Advisory Committee relating to the development, use, importation, storage, handling or movement of any food that is or contains a living modified organism.".
