PUBLIC SERVICE (AMENDMENT) ACT 2018

AN ACT TO AMEND THE PUBLIC SERVICE ACT TO ALIGN THE REPORTING OBLIGATIONS OF MINISTRIES WITH THE FINANCIAL YEAR

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1 Short title and Interpretation

(1) This Act may be cited as the Public Service (Amendment) Act 2018.

(2) In this Act, the Public Service Act 2002, as amended, shall be referred to as the “Principal Act”.

2 Section 8 amended

Section 8 of the Principal Act is amended by –

(a) deleting the word “May” and replacing it with the word “September”; and
(b) inserting after the word “Commission” the words “, during the previous financial year,”.

3 Section 13F amended

Section 13F of the Principal Act is amended –

(a) in subsection (1) by -

• (i) inserting after the word “Ministry” the words “,during the previous financial year,”; and
• (ii) deleting the word “May” and replacing it with the word “September”; and

(b) in subsection (3) by –

• (i) re-numbering paragraphs “(e)” and “(f)”, as paragraphs “(f)” and “(g)” respectively; and
• (ii) inserting the following new paragraph (e) immediately after paragraph (d) –
  • “(e) the annual financial statements of receipts and payments, and statements of assets and liabilities, of the Ministry;”.
