TONGA ELECTRIC POWER BOARD (AMENDMENT) ACT

AN ACT
TO AMEND THE TONGA ELECTRIC POWER BOARD ACT

[10th of July 2002.]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Tonga Electric Power Board (Amendment) Act 2002.

(2) The Tonga Electric Power Board Act (Cap. 93), as amended, is in this Act referred to as the Principal Act.

2. Section 5 of the Principal Act is amended by -

(i) deleting all the words beginning at the words "The Board shall" in line 2 of subsection (1) to the end of the subsection.

(ii) deleting subsection (IA);

(iii) inserting the following new subsections after subsection (1)-

"(2) the Board shall have not more than 5 members.

(3) His Majesty in Council shall appoint all the members of the Board, and any one of those members as Chairman, on the nomination of the Prime Minister in Cabinet. A member shall hold office for 3 years and shall be eligible for re-appointment."

(iv) re-numbering subsections (2) and (3) as subsections (4) and (5) respectively.

3. Section 7 of the Principal Act is repealed.

4. Section 8(3) of the Principal Act is amended by deleting the number "5" and substituting "3". 2002.

(i) tamate'i 'a e ngaahi fo'i lea kotoa pe 'o kamata mei he fo'i lea, "Ko e Komiti pehe' 'i he laine 2 'o e kupusi'i (1) ki he ngata'anga 'o e kupusi'i ko ia';

(ii) tamate'i 'a e kupusi'i (IA);

(iii) fakahu atu 'a e ongo kupusi'i ko 'eni' hili 'a e kupusi'i (I)-

"(2) kuo pau ke 'oua 'e to e tokolahi ange 'a e Komiti he toko 5.

(3) Kuo pau ke fokotu'u 'e he 'Ene 'Afio' 'i he Fakataha Tokoni' 'a e kau memipa kotoa pe 'o e Komiti', mo ha taha 'o e kau memipa ko ia'ke Sea, 'i hano fokotu'u hingoa atu 'e he Palemia 'i he Kapineti. Kuo pau ke ma'u lakanga ha memipa ki he ta'u 'e 3 pea kuo pau 'e lava ke toe-fokotu'u ia."

3. 'Oku fakapekia 'a e kupu 7 'o e Tefito'i Lao'.

4. 'Oku fakatonutonu 'a e kupu 8(3) 'o e Tefito'i Lao' 'aki hono tamate'i ^,a e fika "5" pea fetongi 'aki 'a e "3".
