METHYLATED SPIRIT REGULATIONS

MADE UNDER SECTION 38 OF THE METHYLATED SPIRIT ACT¹

Commencement [1 June, 1985]

1 Citation

These Regulations may be cited as the Methylated Spirit Regulations.

2 Methylated Spirit Licence

(1) An application for a methylated spirit licence shall be made to the Secretary to Government in Form 1.

(2) A methylated spirit licence shall be in Form 2 and may be subject to such conditions as the licensing authority specifies.

3 Storage of Methylated Spirit

A holder of a methylated spirit licence shall satisfy the Secretary to Government or any public official acting on his behalf that at all time stocks of methylated spirit are securely stored in a locked place, and that proper provision has been made to prevent fire and unlawful access.

4 Records of Stocks

A holder of a methylated spirit licence shall keep a methylated spirit register in Form 3, showing details in accordance with that Form of all methylated spirit which he —

(a) acquires

• (b) holds, and
  

(c) disposes of whether by sale or otherwise.

5 Maintenance of register

(1) A holder of a methylated spirit licence shall make an immediate entry in the methylated spirit register recording any sale, disposal, use, loss or destruction of any methylated spirit.

(2) All entries in a methylated spirit register made under this Regulation shall be retained for 12 months.

6 Offences

(1) The Secretary to Government or any public official acting on his behalf, and any police officer may inspect a methylated spirit register at any time.

(2) Any holder of a methylated spirit licence who fails to maintain records of stock and the disposal of that stock in accordance with these Regulations commits an offence.
