AN ACT to amend the Wreck and Salvage Act to reduce the time for establishing claims and to facilitate the sale of unclaimed wreck; and for connected purposes.

ENACTED by the Parliament of Tuvalu-


Short title and Commencement


1. This Act may be cited as the Wreck and Salvage (Amendment) Act 1991 and shall come into operation on such date as the Minister by notice shall appoint.


Amendment of section 30 of Cap. 91


2. Section 30 of the Wreck and Salvage Act is amended by repealing the words "within 1 year" and substituting the words "within 6 months".


Amendment of section 32 of Cap. 91


3. Section 32 of the Wreck and Salvage Act is amended by repealing the words "the expiration of a year" and substituting the words "the expiration of six months".


Addition of new section 30 of Cap. 91


4. The Wreck and Salvage Act is amended by adding after section 37 the following new section:


"38. Where under this Act the receiver is empowered to sell any vessel, cargo, apparel or wreck, such sale may take place at such place in Tuvalu or elsewhere as the receiver may determine."

WRECK AND SALVAGE (AMENDMENT) ACT 1990


EXPLANATORY MEMORANDUM
(This memorandum is not part of the Act)


This Act amends the Wreck and Salvage Act (Cap. 91) to reduce the time for the owner of wrecked goods to make its claim, and to give greater flexibility in the sale of wrecked goods.


Section 2 and 3 have the effect of reducing the period within which the owner must establish his claim from one year to six months: This means that if the goods are unclaimed after six months, they may then be sold.
