LAND LEASES (AMENDMENT)
ACT NO. 10 OF 2016

An Act to amend the Land Leases Act [CAP 163].

Be it enacted by the President and Parliament as follows-

1. Amendment

The Land Leases Act [CAP 163] is amended as set out in the Schedule.

2. Commencement

This Act commences on the day on which it is published in the Gazette.

SCHEDULE

AMENDMENTS OF THE LAND LEASES ACT [CAP 163]

1. Reference to “Companies Act [CAP 191]”

Delete “Companies Act [CAP 191]” (wherever occurring), substitute “Companies Act No. 25 of 2012”

2. Subparagraph 4(2)(b)(ii)

After “corporation”, insert “incorporated in Vanuatu”

3. Subsubparagraph 4(2)(b)(ii)(D)

Delete “and”, substitute “or”

4. After subsubparagraph 4(2)(b)(ii)(D)

Insert

“(iii) if the lessee is a corporation incorporated in a jurisdiction other than Vanuatu:

(A) provide the relevant incorporation documentation or certification of the jurisdiction where the corporation has been registered; and

(B) provide any other document as required by the Director; and”

5. Section 32E

Repeal the section.

6. Subsection 38A(7)

Delete “43”, substitute “44”

7. Subsection 38B(4)

Delete “43”, substitute “44”
