REPUBLIC OF VANUATU

MUNICIPALITIES (AMENDMENT) ACT
NO. 11 OF 1995

An Act to amend the Municipalities Act [CAP. 126].

BE IT ENACTED by the President and Parliament as follows: -

AMENDMENT OF PART V OF CHAPTER 126

1. Part V of the Municipalities Act [CAP. 126] is amended by inserting after section 19 the following new section -
   

"MUNICIPAL WARDENS

19A. (1) A council may appoint fit persons, not being councilors, to be municipal wardens upon terms and conditions as it may determine.

(2) The municipal wardens shall, under the direction of the council of each municipality -

(a) be responsible for the enforcement of municipal bye-laws;

(b) exercise such powers and perform such duties as are by law conferred or imposed on municipal wardens.

(3) For the avoidance of doubt -

(a) members of the Vanuatu Police Force shall continue to exercise their normal powers and duties within a municipality;

(b) neither this provision nor any bye-law shall confer on a warden any power of search, arrest or other compulsion in respect of a civil matter (for example, a debt), unless such action is permitted to be taken by a person other than a police officer in respect of such matter by the provisions of the Criminal Procedure Code Act [CAP. 136] or such action is taken pursuant to an order of the Court.

(4) Members of the Vanuatu Police Force may be seconded to act as municipal wardens in accordance with the provisions of the Police Act [CAP. 105]."

COMMENCEMENT

2. This Act shall come into force on the date of its publication in the Gazette.
