VANUATU QUALIFICATIONS AUTHORITY (AMENDMENT)
ACT NO. 36 OF 2019

An Act to amend the Vanuatu Qualifications Authority Act No. 1 of 2014.

Be it enacted by the President and Parliament as follows-

1. Amendment

The Vanuatu Qualifications Authority Act No. 1 of 2014 is amended as set out in the Schedule.

2. Commencement

This Act commences on the day on which it is published in the Gazette.

SCHEDULE

AMENDMENTS OF VANUATU QUALIFICATIONS AUTHORITY ACT NO. 1 OF 2014

1. Section 1 (definition of TVET)

Repeal the definition.

2. Paragraphs 3(1)(p) and (r)

Repeal the paragraphs.

3. Section 7

Delete “The” (first occurring), substitute “(1) The”

4. Paragraph 7(a)

Delete “of the Ministry of Education and Training”

5. Paragraph 7(b)

Delete “Youth Development, Training and Sport”, substitute “Tertiary and Higher Education”

6. Paragraph 7(l)

Repeal the paragraph, substitute

“(l) a representative of the education and training providers nominated by the Association of Post School Education and Training Providers.”

7. At the end of section 7

Add

“(2) The Minister is to appoint the members nominated under paragraphs (1)(h) and (l).

(3) For the purposes of this section, Association of Post School Education and Training Providers means the association of providers delivering Post School Education Training courses in Vanuatu.”

8. Subsection 8(2)

Delete “Technical, Vocational Education and Training”, substitute “Post-School Education and Training”

9. Subsection 19(3)

Delete “local TVET centre”, substitute “Provincial Skills Centre”

10. Paragraph 19(2)(a)

Delete “TVET”, substitute “Post-School Education and Training”

11. Subsection 22(1)

Delete “Government TVET”, substitute “Skills”

12. After subsection 40(1)

Insert

“(1A) A registered provider must not deliver unaccredited courses.”

13. Subsection 40(2)

Delete “subsection (1)”, substitute “subsections (1) and (1A)”

14. Section 42

Repeal the section.

15. Paragraph 45(2)(b)

Delete “TVET”
