THE BANKRUPTCY (AMENDMENT NO.2) RULES 1982

The Lord Chancellor, in exercise of the powers conferred on him by section 132 of the Bankruptcy Act 1914(a) and of all other powers enabling him in that behalf, with the concurrence of the Secretary of State for Trade, and after consulting the committee appointed under section 10 of the Insolvency Act 1976(b), hereby makes the following Rules:-
1. These Rules may be cited as the Bankruptcy (Amendment No. 2) Rules 1982 and shall come into operation on 9th September 1982.
2. The Bankruptcy Rules 1952(c) shall be amended by substituting for the words from "An auctioneer" to "per mile" in the General heading in Appendix III the words:-
"An auctioneer who uses his own car shall be entitled, if the Taxing Officer is satisfied that such use was reasonable, to such allowance per mile as the Lord Chancellor and the Secretary of State for Trade, having regard to the rates applicable to those employed in the civil service, shall direct."

EXPLANATORY NOTE
(This Note is not part of the Rules.)
These Rules amend Appendix III to the Bankruptcy Rules 1952 so as to enable the Lord Chancellor and the Secretary of State for Trade to direct, having regard to the rates applicable to the Civil Service, the car mileage allowance to be paid to an auctioneer in bankruptcy matters.
