MEMBERSHIP OF STATUTORY
BOARDS AND AUTHORITIES ACT 2001
2001 No. 9
AN ACT to amend various Acts to provide for changes to the membership of Boards, Authorities and other Bodies.
[Assent and commencement date: 29 June 2001]
BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:
1. Short title and commencement – (1) This Act may be cited as the Membership of Statutory Boards and Authorities Act 2001.
(2) This Act comes into force on the day it is assented to by the Head of State.
2. Agriculture Store Board – Section 3(2)(d) of the Agriculture Store Corporation Act 1975 is amended by deleting the word “three” and substituting the word “six”.
3. Samoa Life Assurance Corporation – Section 3(2)(d) of the Life Assurance Corporation Act 1976 is amended by deleting the word “two” and substituting the word “three”.
4. Housing Corporation – Section 3(2)(f) of the Housing Corporation Act 1989 is amended by deleting the word “three” and substituting the word “four”.
5. National Provident Fund – Section 3(1) of the National Provident Fund Act 1972 is amended by inserting the following paragraph after paragraph (h):
“(i) A person appointed by the Head of State acting on the advice of Cabinet”.
6. Liquor Control Board – Section 3(1) of the Liquor Act 1971 is amended by deleting the word “three” and substituting the word “four”.
7. Film Control Board - (1) Section 4(1) of the Film Control Act 1978 is amended as follows:
(a) by deleting paragraphs (c), (d), (e) and (f) and substituting the following:
“(c) the Commissioner of Police Service;”
(b) by inserting after paragraph (c) the following:
“(d) the Comptroller of Customs;
(e) the Secretary for Women Affairs;
(f) one person appointed by the Head of State, acting on the advice of Cabinet, to represent religious organizations; and
(g) two persons appointed by the Head of State, acting on the advice of Cabinet, to represent the public.”
(2) Section 4(2) of the Film Control Act 1978 is amended by inserting in paragraph (a) after the word “Education” the following words “and the Commissioner of
Police Service and the Comptroller of Customs and the Secretary for Women Affairs.”
8. Samoa Trusts Estates Corporation Board – Section 3(2) of the Samoa Trusts Estates Corporation Act 1977 is amended as follows:
(a) by deleting the word “Five” from paragraph (c) and substituting the word “Six”; and
(b) by inserting after paragraph (c) the following paragraph:
“(d) the General Manager.”
9. Trade, Commerce and Industry Development Board – Section 5(3) of the Trade Commerce and Industry Act 1990 is amended by inserting after paragraph (m) the following paragraph:
“(n) the Commissioner of Inland Revenue.”
10. Samoa Visitors Bureau Board – Section 3(3) of the Samoa Visitors Bureau Act 1984 is amended by deleting paragraph (d) and substituting the following paragraph:
“(d) eight persons appointed by the Head of State, acting on the advice of Cabinet, to represent the interests of the tourist industry and the public.”
11. Airport Authority – Section 4 of the Airport Authority Act 1984 is amended by deleting subsection (2) and substituting the following subsection:
“(2) The Board shall consist of a Chairman, the Civil Aviation Manager and six other directors who shall be appointed by the
Head of State, acting on the advice of Cabinet, from amongst persons of recognized competence and experience in financial or commercial
matters”.
12. Transport Control Board – Section 51 of the Road Traffic Ordinance 1960 is amended by deleting subsections (1) and (2) and substituting the following subsections:
“(1) There is hereby constituted the Transport Control Board.
(2) The Board shall consist of:
(a) the Chairperson, appointed by the Minister for a term of two years, but may be reappointed;
(b) the Secretary for Transport;
(c) the Director of Works;
(d) the Manager of the Accident Compensation Board;
(e) the Commissioner of Police Service or a nominee of the Commissioner; and
(f) three persons, appointed by the Minister for a term of two years, but may be reappointed.”
13. Ports Authority – Section 5(1) of the Ports Authority Act 1998 is amended by deleting the word “four” and substituting the word “six”.
14. Samoa Water Authority Board - (1) Section 11 of the Water Authority Act 1993/1994 is amended as follows:
(a) by deleting the expression “nine (9)” from subsection (1) and substituting the word “ten”; and
(b) by deleting the words “Director of Works” from subsection (2)(b) and substituting the words “General Manager”;
(c) by inserting after paragraph (g) in subsection (2) the following paragraph:
“(h) the Director of Works.”
(2) Section 12(1) of the Water Authority Act 1993/1994 is amended by deleting the expression “and (f)” and substituting the
expression “(f) and (h)”.
15. Televise Samoa Board – Section 17 of the Televise Samoa Corporation Act 1994 is amended as follows:
(a) by deleting the expression “seven (7)” from subsection (1) and substituting the expression “eleven (11)”; and
(b) by deleting the word “Three” from subsection (2)(e) and substituting the word “Six”.
16. Apia Park and Sports Facilities Board – Section 4 of the Apia Park and Sports Facilities Board Act 1995 is amended by:
(a) relettering paragraph (e) as paragraph (f) and by deleting the letter “(c)” and substituting the letter “(e)”; and
(b) inserting after paragraph (d) the following paragraph:
“(e) the Director of Works”.
17. Electric Power Corporation – Section 5(1) of the Electric Power Corporation Act 1980 is amended as follows:
(a) by deleting the figure “7” and inserting the figure “8”;
(b) by deleting the words “Director of Works” in paragraph (b) and substituting the words “General Manager”; and
(c) by inserting after paragraph (e) the following paragraph:
“(f) the Director of Works.”.
REVISION NOTES 2008 – 2012
This Act has been revised under section 5 of the Revision and Publication of Laws Act 2008.
Note: The Liquor Act 1971 amended by section 6 has been repealed.
There were no amendments made to this Act since the publication of the Consolidated and Revised Statutes of Samoa 2007.
This Act has been revised in 2008, 2009, 2010, 2011 and 2012 by the Attorney General under the authority of the Revision and Publication of Laws Act 2008 and is the official version of this Act as at 31 December 2011. It is an offence to publish this Act without approval or to make any unauthorised change to an electronic version of this Act.
