ELECTORAL AMENDMENT REGULATIONS 2006

Pursuant to section 136 of the Electoral Act 1963, I, MALIETOA TANUMAFAILI II, Head of State of the Independent State of Samoa, acting on the advice of Cabinet, BY ORDER MAKE the following Regulations:

1. Short title and commencement- (1) These Regulations may be cited as the Electoral Amendment Regulations 2006.


(2) These Regulations commence on the day they are made and notice of the making of these Regulations shall be published in Samoan and English in the Savali and one other newspaper circulating in Samoa.


2. Principal Regulations - In these Regulations, "Principal Regulations" means the Electoral Regulations 1991.


3. Interpretation - Regulation 2 of the Principal Regulations is amended by omitting the definition of "Registrar".


4. References to Chief Returning Officer and Registrar - The Principal Regulations are amended by omitting "Chief Returning Officer" and "Registrar" wherever occurring and substituting "Electoral Commissioner".


5. Voting by way of special vote - Regulation 5 of the Principal Regulations is amended by omitting from subregulation (1) "who is in possession of a certificate of identity" and substituting "who has been registered as an elector or voter".


6. Insertion of new regulation - After regulation 21 of the Principal Regulations the following regulation is inserted:


“21A. Finger of elector or voter to be marked with indelible substance-(1) Subject to subregulation (2), before to Chief being given a ballot paper under section 70 of the Act, each elector or voter must have one finger marked by the Presiding Officer with an indelible substance in the way that the Commissioner directs.


(2) If a voter or elector cannot have a finger marked because of a physical disability, the Presiding Officer must note on the roll before issuing that voter or elector with a ballot paper that the voter or elector cannot be marked with an indelible substance.


(3) If the presiding officer considers that one of the person's fingers is already marked with an indelible substance pursuant to subregulation (1), that person's claim to vote must be rejected and that person shall not be issued with a ballot paper.".
