ORDER

PURSUANT to Section 56 of the Fair Trading Act 1998, the Prices Board hereby makes the following Order:

1. Title and Commencement - This Order may be cited as the Prices Board's Special Price Order 2006 No. 1 for British American Tobacco Samoa Ltd's Locally Manufactured Cigarette & Tobacco for Upolu, Savaii and Manono Tai. This Special Price Order shall come into force on the 1^st May 2006.

2. Maximum Prices - The prices set out in Schedule One (1) below shall be the Maximum Prices to be applied for locally manufactured Cigarettes and Tobacco at Wholesale and Retail Stores.

3. Traders to display prices - All traders are to clearly display, and mark prices of cigarettes and tobacco manufactured by British American Tobacco Samoa Ltd by either affixing, or noting the price on the packets or by displaying the price on the shelf or stand on which the goods are being displayed for sale.

4. Revocation - The Special Price Order 2003 No. 1 for the Locally Manufactured Vailima Beer, Cigarette and Tobacco is hereby revoked.

5. Penalties - Under Section 35 of the Fair Trading Act 1998,

(1) Every person who acts in contravention of any provisions of this Act or any regulations made thereunder shall be guilty of any offence under this Act. Every person guilty of an offence under this Act shall on conviction be liable:

(a) To a fine not exceeding $3,000 or to imprisonment for a period not exceeding one year or to both fines on first offence;

(b) A second or subsequent offence to a fine not exceeding $7,000 or to imprisonment for a period not exceeding two years or to both fine and imprisonment.

(2) The Court may order the forfeiture of any goods in respect of which the offence was committed.

(3) The Court may order the offender to stop carrying on business of selling goods for a certain period.

(4) The Secretary shall publish the name, or address and signed description of every person in respect of whom the Court has made an order under 3 above.

6. Schedule - Schedule 1 (below) describes the maximum prices for Pall Mall Filter (Rothmans), Pail Mall Menthol (Consulate) and Pocket Edition (Roll Your Own) tobacco manufactured locally by British American Tobacco Samoa Ltd, at Wholesale and Retail level.
